1. Seller and scope
These terms apply to the sale of original artworks and to services (commissioned portraits and photo sessions) contracted through olesiashelk.art. Seller: Olesia Shelkovenko, self-employed (trabalhadora independente), tax number (NIF) 314503919, Rua Alcaide de Faria, 193, 4100-035 Porto, Portugal, email [email protected], phone +351 963 457 211 (call to a Portuguese mobile network). Version of 13 October 2026.
2. How the contract is concluded
1) Choose a work and check its description (technique, support, size, frame), the price and the shipping cost to your country. 2) The buy button takes you to Stripe's secure payment page, where you see the total (artwork + shipping) before you confirm. Until you press the final payment button you can correct your details or cancel. 3) The contract is concluded when the payment is confirmed. We email you an order confirmation with these terms and the model withdrawal form within 5 days at the latest and always before delivery. The contract may be concluded in Portuguese, English or Russian; in case of discrepancy the Portuguese version prevails. We keep a copy of the confirmation; you can save or print this page.
3. Prices
Prices are shown in euros (EUR). Shipping is not included in the artwork price: it is shown on the artwork page for the country you choose and on the payment page before you confirm.
4. Delivery
We ship with UPS, always with tracking and packaging included. The shipping cost depends on the country and the size of the work; it is shown on the artwork page and on the payment page before you confirm.
Timing: dispatch within 5 business days of payment; UPS delivery usually takes 2–5 business days within the European Union. Unless another date is agreed, delivery takes place no later than 30 days after the contract is concluded.
We currently ship only to European Union countries and Monaco. Azores, Canary Islands, Ceuta, Melilla, French outermost regions and the Åland Islands: please contact us before paying. For other countries, write to [email protected].
We bear the risk of loss or damage in transit until the work is delivered to you.
5. Payment
Online payment by card or other methods offered by Stripe on the payment page. For collection in Porto you may pay online or in cash; by law, cash is accepted only for amounts below €3,000 (€10,000 for private non-residents), counting all payments for the same purchase together.
6. Viewing and collection in Porto
You can view works and collect your order at Rua Alcaide de Faria, 193, Porto, by appointment only. A purchase paid online and collected in Porto is a distance purchase: the 14-day withdrawal period starts on collection.
7. Right of withdrawal (14 days)
You have the right to withdraw from this contract within 14 days without giving any reason. The period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquire physical possession of the work. To exercise this right, inform us (Olesia Shelkovenko, Rua Alcaide de Faria, 193, 4100-035 Porto, phone +351 963 457 211 (call to a Portuguese mobile network), email [email protected]) of your decision by an unequivocal statement (e.g. email or letter). You may use the model withdrawal form, but it is not obligatory. To meet the deadline it is sufficient to send your communication before the period has expired.
Effects: we will reimburse all payments received from you, including delivery costs (except supplementary costs from choosing a delivery type other than the least expensive standard delivery we offer), within 14 days of being informed of your decision, using the same means of payment, at no cost to you. We may withhold reimbursement until we have received the work back or you have supplied proof of having sent it, whichever is earlier. Please return the work, well packed, to Rua Alcaide de Faria, 193, 4100-035 Porto within 14 days of telling us. You bear the direct cost of return; as a rule it is about the shipping cost to your country shown at purchase (within mainland EU up to €95 for the largest formats). You are only liable for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the work.
8. Commissioned works
There is no right of withdrawal for works made to your specifications or clearly personalised — for example portraits of people or pets painted from your photos (Article 17(1)(c) of Portuguese Decree-Law 24/2014). The legal guarantee of conformity still applies to these works. Before starting, we agree by email on size, technique, reference photo, timing and price.
9. Photo sessions
For photo sessions booked at a distance you have 14 days from the conclusion of the contract to withdraw. If you want the session to take place within that period, please request it expressly by email and acknowledge that you lose the right of withdrawal once the service has been fully performed. If you withdraw after performance has begun, you pay an amount proportionate to what has been provided. The service is fully performed when the final photos are delivered.
10. Damage in transit and legal guarantee
If the work arrives damaged, contact us with photos of the packaging and the work, preferably within 48 hours (a recommendation that does not limit your rights). In that case we bear the return costs and you may choose a full refund including shipping or, if you prefer, restoration or a price reduction. Legal guarantee of conformity: 3 years from delivery (Portuguese Decree-Law 84/2021); a lack of conformity appearing within the first 2 years is presumed to have existed at delivery. These terms do not limit your statutory rights.
11. Complaints and dispute resolution
Complaints: [email protected] or phone +351 963 457 211 (call to a Portuguese mobile network). Portuguese electronic Complaints Book: https://www.livroreclamacoes.pt. In the event of a consumer dispute you may use an alternative dispute resolution entity: CICAP – Porto Consumer Information and Arbitration Centre, Rua Damião de Góis, 31, Loja 6, 4050-225 Porto, https://www.cicap.pt; CNIACC, https://www.cniacc.pt; or another competent entity listed at https://www.consumidor.gov.pt (Portuguese Law No. 144/2015). Consumer disputes up to €5,000 may be referred to arbitration at the consumer's choice (Article 14 of Law 24/96).
12. Personal data
Order data (name, address, email, phone) are processed to perform the contract and meet tax obligations, and shared with Stripe (payment) and UPS (delivery). More: Privacy policy.
13. Applicable law
These terms are governed by Portuguese law. If you are a consumer habitually resident in another country, you keep the protection of the mandatory provisions of that country's law (Article 6 of Regulation (EC) 593/2008, Rome I).
Version of 13 October 2026. In case of discrepancy between language versions, the Portuguese version prevails.
